Notice of Proposed Class Action Settlement

D.R. v. Michigan Dep’t of Educ. et al., Case No. 16-cv-16-CV-13694-AJT-APP

In 2016, a putative class action lawsuit was filed against the Michigan Department of Education, the Genesee Intermediate School District, and Flint Community Schools (collectively, the “Defendants”) alleging violations of the rights of students who were eligible or who should have been found eligible for special education and related services. A settlement agreement has now been reached in the case.

Notice of Flint Early Childhood Education Needs Assessment Report

In December 2025, the Genesee Intermediate School District, in partnership with the American Institutes for Research (AIR), completed the Flint Early Childhood Education Needs Assessment Report. This report was produced as part of ongoing efforts to understand and address access to high-quality early childhood education for Flint’s 3- and 4-year-old children.

The report analyzes the current availability of high-quality preschool programs in Flint, estimates the number of children who are not currently served, and identifies the resources and funding needed to expand equitable access. It also outlines recommended strategies related to family outreach, transportation, and system planning to support universal access to high-quality early childhood education.

Special Education Fund Financial Report

In accordance with the Special Education Fund Distribution Plan, the Special Education Fund Financial Report is provided as an overview of expenditures to date and will be provided bi-annually for review.

Support for Students Affected by the Flint Water Emergency

Genesee Intermediate School District provides programs and services for children impacted by the Flint Water Emergency who currently live, or have lived within the past nine years, within the boundaries of Flint Community Schools. These services are provided pursuant to applicable settlement agreements addressing general education supports.

To help us maintain accurate records, families are encouraged to contact us if they believe their child was affected but may not have been identified based on their address at the time of school enrollment.

Support for Students with Disabilities Affected by the Flint Water Emergency

Genesee Intermediate School District provides literacy and behavioral support services for students with disabilities, as defined under applicable special education laws, who were impacted by the Flint Water Emergency and resided within the boundaries of Flint Community Schools between April 2014 and December 31, 2018, as outlined in the Settlement Agreement.

Families may initiate a referral for literacy and/or behavioral support if they believe their child, as a student with a disability, was impacted during this time period and may be eligible for services. To ensure services are provided appropriately and in accordance with the Settlement Agreement, all family referrals are coordinated through the district’s intake process.

If you believe your child may be eligible for literacy or behavioral support, or if you need to update or review your child’s information, please contact our intake specialist. An intake specialist will review the information provided, confirm eligibility consistent with the Settlement Agreement, and coordinate next steps with the appropriate service providers.
